The defendant in the alleged corruption case of ADD Long Titi, Sungai Tubu District was carried out in the 2019 and 2020 fiscal years, according to the head of the Malinau District Attorney’s Office (Kejari), Daniel Martua Hutagalung, through the Head of Intel, Slamet Riyono.
The defendant has been proven to have committed a criminal act of corruption, according to the primary indictment, according to the Public Prosecutor (JPU). Article 2 paragraph (1), in conjunction with Article 18 of Law No. 31 of 1999 on Corruption Eradication. As amended and added to by Law No. 20 of 2001 concerning Amendments to Law No. 31 of 1999 Concerning the Eradication of Corruption, in conjunction with Article 64 paragraph (1) of the 1st Criminal Code.
“The state suffered a loss of Rp. 349,655,958 as a result of this case.” We demand that the defendant be sentenced to 5 years in prison plus a fine of Rp. 200 million, minus the time spent in detention. “We also ask the panel of judges who examined and tried this case to find the defendant guilty of committing a criminal act of corruption,” he said on Tuesday (April 26th, 2022).
If the Rp200 million fine is not paid, the prosecutor demands that the defendant serve an additional month in prison in lieu of the fine. In addition, the defendant was ordered to pay a Rp. 349,655,958 replacement fee.
According to the provisions, if the convict fails to pay the replacement money within one month after the decision becomes permanent, the prosecutor may seize the convict’s property. If the convict does not have enough assets to replace the money, he or she is sentenced to 1 (one) year in prison.
“All evidence in this case,” he explained, “we ask to be attached to the case file.”
After reading this claim, the Panel of Judges will allow the defendant and his legal counsel to present their case at the next trial, which will be held on Monday (9/5) next week.
